Products Liability and Toxic Torts
Stoel Rives sees products liability defense work as a key component of our overall business litigation practice. A core group of approximately 30 lawyers and paralegals across our offices focuses on the defense of products liability claims for manufacturers and distributors of all types of consumer and industrial products. In addition, we represent a number of clients, both insured and self-insured, defending personal injury, property damage and premises owner claims.
Our trial lawyers are able to manage and try products liability cases, including personal injury and premises liability cases, throughout the western United States and beyond. In addition to the states where we have offices, our lawyers have successfully defended actions in Colorado, Wyoming, Pennsylvania, Michigan, Illinois, Texas, Virginia and Louisiana.
Thorough Preparation
We approach our products liability cases as we do our other complex litigation—through a strategic method of analysis and preparation. First, we undertake a critical evaluation of the factual and legal merits of the case. Based on that work, we create case maps that include an analysis of potential motions we may make or anticipate receiving; prepare a discovery plan; plan for electronic management of documents, transcripts and other evidentiary material; outline trial preparation strategies; and include settlement valuations and strategies, if appropriate. This process provides a useful framework to assist us in providing substantive advice to the client and also serves as the basis for developing a meaningful litigation budget.
We frequently involve jury consultants in the process of formulating case strategies and to test various approaches prior to dispositive phases of cases and trials.
Range of Clients
We have defended pharmaceutical and chemical companies, automobile makers and farm equipment manufacturers, among others, in cases involving substantial injury due to claimed defects. In addition to serving as trial counsel for manufacturers, our lawyers also oversee and supervise multi-defendant mass tort litigation. We are able to advise clients on strategies to avoid or limit future products liability claims. Our trial experience allows us to secure the best possible outcomes in cases where claims are unavoidable.
Specific Products Experience
Our lawyers have handled products liability cases with regard to asbestosis, silicosis, cancer, fires, alleged mental illness and bodily injuries. We have defended claims arising from alleged defects in electrical products, phenolics, brakes, valves, motors and gears, and pharmaceutical and medical products, along with other product types.
